AB 962 Determined Unconstitutional 012311
The National Rifle Association / California Rifle and Pistol Association (CRPA) Foundation were awarded a victory by Fresno Superior Court Judge Jeffrey Hamilton, who ruled that AB 962 was unconstitutionally vague.
The bill, had it become law, would have required local ammunition dealers to keep unreasonable records on purchases, and would have prevented mail order ammunition sales.
The bill was an attempt by anti-gun legislators to shrink the liberty implied in the 2nd Amendment.
The primary plaintiff was Tehama County Sheriff Clay Parker, and additional plaintiffs included the California Rifle Pistol Association Foundation, Herb Bauer Sporting Goods, Able’s Ammo, and RTG Sporting Collectibles.
Judge Hamilton might be overruled, either by appeal or by legislative act, but for now, the gun owners of California can still buy ammunition without creating a government paper trail.
